Terms and conditions of sale

1. Purpose

These Terms and Conditions of Sale (T&Cs) govern all sales made through the website www.mongeve.com. By placing an order, the customer agrees to abide by these terms in full.

2. Orders

2.1 Order Process

Orders are placed exclusively via the Mongève website. The customer selects the desired products, adds them to their cart, and confirms the order by completing payment. An order confirmation email is sent upon successful payment.

2.2 Order Modification & Cancellation

Orders can be modified or canceled only before they are shipped. Once shipped, modifications are not possible, and the return policy applies.

Mongève reserves the right to refuse any order for legitimate reasons, such as suspected fraudulent activity.

3. Prices & Payment

3.1 Pricing

All prices on the website are displayed in euros (€) and include all applicable taxes (TTC). Shipping costs, where applicable, are displayed before order confirmation.

3.2 Payment Methods

Mongève accepts the following payment methods:

• Credit/debit cards (Visa, Mastercard, American Express)

• PayPal

• Apple Pay

• Google Pay

Payments are processed securely via Shopify Payments, ensuring encrypted transactions.

3.3 Payment Security

Mongève does not store customer payment details. Transactions are handled securely by third-party payment providers.

4. Shipping & Delivery

4.1 Shipping Zones

Mongève ships worldwide.

4.2 Delivery Times

• Standard Shipping: 3 to 5 business days after a processing time of 2 days.

• Express Shipping: Available at an additional cost, calculated at checkout based on destination.

4.3 Shipping Costs

• Standard Shipping: Free worldwide.

• Express Shipping: Fee varies based on location and is displayed at checkout.

4.4 Order Tracking

Once the order is shipped, a tracking number will be provided by email, allowing customers to monitor delivery progress.

Mongève is not responsible for delays caused by customs processing or unforeseen logistical issues.

5. Right of Withdrawal & Returns

5.1 Right of Withdrawal

Customers have 14 days from receipt of their order to exercise their right of withdrawal and return products, provided they meet the return conditions.

5.2 Return Conditions

• Products must be unused and in their original packaging.

• Damaged, worn, or incomplete items will not be accepted for return.

• Customers must contact Mongève at info@mongeve.com to obtain the return address and instructions.

• Return shipping costs are covered by Mongève.

5.3 Refunds

• Refunds are processed within 5 business days after receipt and inspection of returned products.

• The refund is issued using the original payment method.

• Shipping costs (if applicable) are not refundable.

6. Product Availability

Mongève ensures product availability at the time of ordering. However, if a product becomes unavailable after purchase, the customer will be informed, and either:

• A refund will be issued, or

• An alternative product will be offered.

7. Warranty & Liability

7.1 Legal Warranty

Products sold on the Mongève website are covered by:

• Legal warranty of conformity (Article L.217-4 and following of the French Consumer Code).

• Warranty against hidden defects (Article 1641 and following of the French Civil Code).

7.2 Exclusions

The warranty does not apply to:

• Damage caused by improper use.

• Normal wear and tear.

• External factors (accidents, improper handling, modifications).

7.3 Customer Responsibility

Customers are responsible for verifying product compatibility with their needs before purchase. Mongève shall not be liable for incorrect product choices.

Mongève shall not be held responsible for delays or non-performance of contractual obligations due to events beyond its control (natural disasters, strikes, transport disruptions, etc.).

9. Dispute Resolution & Governing Law

These T&Cs are governed by French law. In case of disputes, the parties shall seek an amicable solution before resorting to legal action.

If no agreement is reached, disputes shall be submitted to the competent courts of Paris, France.
